1Scope ofapplication
These General Terms and Conditions (hereinafter "GTC") apply to all negotiation deeds concluded through the online shops www.eurotrex.ch (hereinafter individually "Online shop"). The online store is managed by Salvatore Marletta (hereinafter "Eurotrex").
The General Terms and Conditions also apply to all legal transactions concluded by Eurotrex under the Marketplace program.
Eurotrex reserves the right to change these GTC at any time. The version of these GTC in force at the time of the order has legal value. This Supporto live offline... version cannot be changed unilaterally. Any customer conditions that diverge or conflict with these GTC are not recognized.
The offer of products and services made available in the online shop (hereinafter "Offer") is aimed exclusively at customers domiciled in Switzerland and Lichtenstein, and in the case of business customers, only if the company is based in Switzerland or Lichtenstein .
Deliveries are limited exclusively to the territory of Switzerland and Lichtenstein.
The offer is valid as long as the product can be found via the search engine of the online store and / or until it is available in stock.
2 Information
2.1 Products and prices
Product images disclosed in advertisements, brochures, online stores, etc. serve as an illustration and are not binding.
All sales prices published in the online shop represent the final prices, which include all taxes (especially VAT), any advance recycling fees (ARF), packaging and shipping costs for the published delivery time. and any other fees or costs will be shown in the shopping cart prior to purchase. Eurotrex reserves the right to change the prices of the products and / or services offered at any time. The price indicated in the online shop at the time of the order is decisive for the conclusion of the purchase contract.
If the customer places an order with a trader domiciled abroad who is not registered in the Swiss VAT register, the customer, as the importer of the products supplied by the trader, is liable for the Swiss import tax and any customs duties. The customer authorizes and instructs Eurotrex (or a third party appointed by Eurotrex) to make the import customs declaration of the products supplied by the reseller in Switzerland in the name and on behalf of the customer and to pay the Swiss duties (import taxes and any duties customs). Customers will pay Eurotrex the expected Swiss import duties in advance together with the purchase price. Any difference with respect to the actual Swiss import duties will be reimbursed to the customer. Eurotrex provides its customers with a customs duty notice in the most suitable form or allows it to be called up electronically. Customer must complain about duty notification within seven (7) business days of receipt or availability. After the expiry of this period, the customer's recourse to Eurotrex for any defects in the import duty notice is excluded.
Additional services subject to charges, if any, are listed separately both in the shopping cart and on the invoice. 2.2 Availability and delivery times
Eurotrex pays particular attention and commitment to the publication of information on availability and delivery times and undertakes to indicate them in the online store in the most accurate and up-to-date, but not binding, manner. However, due to production and supply problems, Eurotrex delivery delays may occur. All information on availability and delivery times are therefore without guarantee and can be changed at any time.
2.3 Additional services: various prints or embroideries
If you choose the personalization of clothing or other items, it is understood that the product cannot be returned in any way. Assembly includes delivery, unpacking, assembly of the ordered products and collection of the packaging material.
Disposal includes the collection and environmentally sustainable disposal of the items indicated by the customer at the time of purchase. These must correspond in form and quantity to the ordered product. The items to be disposed of are supplied by the customer ready for transport, respecting the delivery terms of the ordered products.
If the customization service cannot be performed for various reasons or problems relating to the image that the customer sends, (e.g. due to failure to send the file format, incorrect dimensional information, etc.), the customer has the right to a refund for the paid service which he was unable to use.
3 Conclusion of contract
The products and prices published in the online shop are valid as an offer, but Eurotrex reserves the right to make an error in the event of an incorrect price indication which terminates the contract.
The sales contract for Eurotrex products or services is concluded with Eurotrex as soon as the customer places an order online, by telephone, or e-mail (hereinafter "Sales Agreement").
If he orders online, the customer receives an order confirmation automatically generated and sent to the e-mail address indicated by him. This confirmation does not guarantee that the product can actually be supplied. It simply informs the customer that the order has arrived in the shop and that the contract with Eurotrex has been concluded, subject to a possibility of delivery and a correct indication of the price and all conditions.
4 Delivery time
With the order confirmation, the customer receives a provisional delivery deadline, or is contacted personally in order to agree on a personalized delivery deadline.
In case of delay in delivery by Eurotrex, the customer has the right to withdraw from the contract (except for special orders with personalization) starting from the thirtieth calendar day from the originally agreed delivery date. In this case Eurotrex reimburses the customer for all amounts already paid. Any further claims against Eurotrex are not possible.
5 Delivery / collection at branch
All delivery and collection possibilities for Eurotrex products and services listed in the online shop under the heading "Delivery and collection" are available to the customer.
The delivery address must be reachable and accessible by truck in Switzerland or Lichtenstein. Otherwise, the customer bears any additional costs.
If the customer chooses the delivery option "Delivery to place of use", the customer guarantees that access to the place of use is possible. If the product cannot be transported to the place of use, the customer bears any additional costs.
If the customer does not fulfill his obligation to accept the product within the pre-established delivery time, Eurotrex has the right to dissolve (cancel) the contract with the customer and charge the customer for the delivery costs incurred and any losses in value.
If the customer does not fulfill his obligation to collect the product from a transport branch (stock) within a period of 7 calendar days from the set collection deadline, Eurotrex has the right to dissolve (cancel) the contract and charge the customer the costs incurred for the return and any losses in value.
6 Obligation to verify
The customer is obliged to immediately and accurately check the conformity, completeness and possible damage of delivery of the products delivered or collected.
In case of postal delivery or other courier, any transport damage must be indicated on the delivery note.
Transport damage, incorrect or incomplete deliveries, must be reported to Eurotrex within 5 calendar days from the time of collection or delivery. The customer is aware of the fact that this report must be made via his email registered in our system at the time of ordering in the online store, by email at "stampadigitale01@gmail.com". The customer is not authorized to use a product of this type and must keep it in the original packaging. The customer undertakes to follow the instructions of the procedure that will be sent by email in response at the time of the request.
7 Warranty
7.1 Basic provisions
Eurotrex guarantees the absence of defects in the product ordered for two years from the date of delivery or collection, always in compliance with the general warranty rules in Switzerland. The duration of the warranty continues regardless of the provision of any warranty service.
Eurotrex can choose the guarantee with:
free repair (the original warranty period continues on all products);
partial or total replacement with an equivalent used / repaired product (in case of replacement during the first year of warranty, the original warranty term continues, in case of replacement during the second year of warranty, the warranty term is 1 year from replacement date); Replacement with a new Eurotrex product (new warranty period of 2 years from the date of replacement);
credit equivalent to the price of the day (at the maximum the sale price at the time of the order);
or perform a handicap.
Eurotrex excludes all wear parts from the guarantee. In addition, the liability conditions set out in point 8 apply.
If the manufacturer's warranty extends further than Eurotrex's, the customer is granted the most extended warranty.
8 Liability and disclaimer
8.1. Responsibility
Liability is based on the legal provisions in force and applicable. Eurotrex assumes no liability for (I) slight negligence, (II) direct, indirect, consequential damages and loss of earnings, (III) unrealized savings, (IV) damages from delivery delays, as well as (V) for all actions and omissions of Eurotrex's auxiliary staff, whether contractual or extra-contractual. In addition, Eurotrex assumes no responsibility for damage resulting from the following causes:
Eurotrex declines all responsibility in the following cases:
improper, non-contractual or illegal storage, regulation or use of the products;
improper modification or repair of the products by the customer or a third party;
force majeure, in particular elementary damage, humidity, fall, impact, etc., not attributable to Eurotrex, as well as provisions of the authority. 8.2. Limitation of Liability
Eurotrex assumes no responsibility for any loss or damage of any kind - direct, indirect, or consequential - resulting from the use or access to Eurotrex websites or from hyperlinks (links) that lead to websites of third parties. Eurotrex does not guarantee that the individual parts of its sites will function perfectly. Eurotrex declines any responsibility for any manipulation of the Internet user's computer system by unauthorized persons.
9 Payment
9.1Methods ofpayment
All payment requests for products and services purchased through the Online Shop are sent to the customer by Eurotrex. Upon conclusion of the purchase agreement, the customer assigns to Eurotrex the entire payment credit deriving from the purchase agreement between the online store and the customer.
Payments must be made in Swiss francs.
Cash payment is only possible in the case of collection at a branch.
Customers can use the payment methods listed in the online shop under "Payment methods".
The current rates are listed under the heading "Methods of payment" and are detailed during the order process.
In case of payment by credit card, the charge is made immediately after placing the order.
In the case of prepayment, delivery takes place only after the payment has been received. The products of Eurotrex central warehouse are reserved until the expiry of the payment term, at least for 3 calendar days.
In case of payment by invoice, the customer undertakes to pay the full invoice amount within 20 calendar days of receipt of the delivery without any deductions. In case of partial return of the delivered products, the invoice amount can be reduced accordingly.
9.2 Late payment
If the customer does not fully fulfill his payment obligations, all outstanding amounts due to Eurotrex, for whatever reason, must be paid immediately (in case of advance payment, within 8 calendar days from the first payment reminder). Eurotrex reserves the right to demand immediate payment of all outstanding amounts and to suspend any deliveries.
Eurotrex reserves the right to levy an inconvenience fee of CHF 5.– from the second payment reminder and CHF 20.– from the third payment reminder. In the event of unsuccessful reminders, the invoice amounts can be transferred to a debt collection office. In this case, an effective annual interest of up to 15% may be further charged from the due date of the invoice. The debt collection office asserts the outstanding amounts in its own name, on its own behalf and may charge additional administrative costs.
9.3 Retention of title
The ordered products remain the property of Eurotrex until their full payment.
10 Modification or cancellation of the order
Orders are binding and the customer is obliged to accept their products and services. Eurotrex may, at its discretion, accept any changes or cancellations of orders and reserves the right to charge the customer an inconvenience fee equal to 20% of the value of the canceled order, at least CHF 20.–, as well as any depreciation of the products. from the moment of the order.
If at the end of the order it proves an impossibility of total or partial delivery, referred to in point 3, the customer is promptly informed by e-mail. If the customer has already made the payment, the total amount will be refunded. If the payment has not yet taken place, the customer is
released from the payment obligation. Further claims in the event of delay or non-delivery are excluded.
11 Return of items without defects
According to the conditions listed in our work policy, Eurotrex grants the right to return the ordered products within 14 days, obviously the product must remain intact to be able to resell it as "new".
The customer undertakes to register the return by email and to return it according to the instructions described therein. The products and all accessories must be properly packaged in the original packaging. Damaged products are not accepted and all related costs are charged to the customer.
If customers make use of the right of withdrawal, Eurotrex will reimburse the entire purchase price less any expenses such as transport costs and any minimum quantity paid and the related return costs. Complete deletion of data must therefore be provided for and requested if necessary.
In relation to any return of products for which customs clearance was on behalf of the customer, the latter authorizes and instructs Eurotrex to declare the products returned for export and to request any refund of Swiss customs duties on behalf of the customer. If customers cannot deduct the import tax and there are other requirements for the refund of this tax due to the re-export of the ordered products, Eurotrex will refund the tax paid by customers in advance after receiving the corresponding amount from the Federal Administration of customs. If the customer appeals to his right of withdrawal, according to the conditions indicated above, Eurotrex undertakes to reimburse the entire sum of the purchase price, excluding any additional minimum quantity and other shipping costs.
In this context, customers assure Eurotrex that the information and list of returned products is complete and correct based on the return receipt generated by the customer in the return process, and that the return shipment actually contains the products indicated in the receipt. back. Customers exempt Eurotrex from all third party claims that refer to an incomplete or incorrect customs declaration by customers. Eurotrex has the right to verify the information provided by its customers in the context of random checks.
12 Collections and returns at a point of sale 12.1 Collection at a point of sale
It is possible to collect or deliver (returns) the items ordered in one of the points of sale indicated by Eurotrex at the time of the request.
After delivery of the package at the point of sale, the customer receives the collection invitation with the relevant notice. The withdrawal notice serves as a means of legitimation and must be presented at the time of withdrawal. This can be, for example, a printed e-mail or the digital version of the collection notice (SMS, WhatsApp, e-mail on the smartphone). The withdrawal code can also be presented separately. There is no further verification of legitimacy. Without the collection notice, the ordered items cannot be delivered to the customer. The point of sale electronically validates the notice which is valid as a take-back certificate. The customer is invited to confirm the collection with his signature. Any liability for any damage to the customer caused by loss, theft, improper use, etc. is expressly excluded. related to the withdrawal procedure, responding to the withdrawal notice.
The customer is solely responsible for late collection of orders. The customer can agree an extension of the collection deadline with the supplier's customer service.
13 Community
By posting comments within our Community, the author automatically accepts the conditions of the Eurotrex Community.
14 Additional provisions
14.1 Returns that cannot be assigned
Returns that cannot be assigned to a customer or cannot be delivered are kept for six months by Eurotrex and subsequently disposed of. 14.2 Data protection
For the modification of personal data by Eurotrex, the information on data protection in Switzerland applies.
14.3 Partial invalidity
Should one or more provisions of these GTC prove to be invalid or ineffective, any different provision and clause of these GTC will retain full force and effect.
14.4 Jurisdiction and applicable law
All legal relations between Eurotrex and the customer are governed by Swiss substantive law. The Vienna Convention on the International Sale of Goods is not applicable.
The following jurisdictions only apply.
For all claims arising from sales contracts in which Eurotrex is a contracting party:
the place of jurisdiction for the consumer's actions is his place of residence.
For all claims arising from sales contracts in which a Merchant based abroad is a contracting party:
the domicile or registered office of the trader is responsible for all consumer complaints. In all other cases, the Court of the Merchant's registered office has exclusive jurisdiction.
